The petitioner seeks bail in Bangaon P.S. case No. 55 of 2016 under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that the accused persons, including the petitioner, demanded extortion. Bailo Yadav is alleged to have assaulted Ram Chandra Sah with spade on his head. While the accused persons were assaulting the informant and others, Upendra Sah intervened but Bishundeo Yadav, the petitioner, assaulted him with iron rod.
The learned counsel for the petitioner submits that Upendra Sah got as many as four injuries but only one injury, that too on the fore arm, was found to be grievous in nature. The
Patna High Court Cr.Misc. No.14910 of 2017 (3) dt.09-05-2017 petitioner is in jail since 24.01.2017.
Considering the facts that there is counter version and assault made by the petitioner caused simple injury, except one which is found on hand, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Saharsa in Bangaon P.S. Case No. 55 of 2016.
