JUSTICE SHIVAJI PANDEY ORAL ORDER 12-02-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek anticipatory bail in a case instituted for the offences under Sections 420, 379, 188 of the Indian Penal Code and Section 40 of the Bihar Minor Mineral Rules, 1972.
Allegation has been made that JCV and tractor of the petitioners were involved in illegal manner.
Learned counsel for the petitioners submits that petitioner no.3, Akhilesh Singh, is a lady aged about 60 years.
Patna High Court Cr.Misc. No.6153 of 2018 (3) dt.12-02-2018 In such view of the matter, in the event of arrest or surrender within four weeks from today, let petitioner no.3, namely, Akhilesh Singh, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VI, East Champaran in connection with Mahesi P.S. Case No.345 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
So far petitioner nos. 1 and 2, namely Bal Naryan Singh and Munchun Kumar are concerned, this Court is not inclined to enlarge them on anticipatory bail. Accordingly their prayer for bail is rejected. However, if the petitioner nos. 1 and 2 surrender before the court below within a period of four weeks, the court below will pass an order on its own merit on the same day without being prejudiced by the order passed by this Court.
