The petitioner apprehends his arrest in connection with Barachatti P.S. Case no. 279 of 2019, registered under Sections 363 and 366 of the Indian Penal Code. The accusation is that co-accused Minu Kumari along with her father Raju Prasad approached to the informant Anju Devi to hand over her two minor daughters, namely, Puja Kumari and Priti Kumari with assurance that they will keep her daughters properly. Thereafter, informant handed over her daughters to Minu Kumari as her husband is a disable person. Later on, her younger daughter Priti Kumari returned to her house, but, in spite of much request her elder daughter Puja Kumari was not returned to the informant.

Patna High Court CR. MISC. No.64476 of 2019(2) dt.04-11-2019 2/2 Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner is not named in the F.I.R. Further submission is that, in fact, Puja Kumar, daughter of the informant left her parental house according to her sweet will and performed marriage with the petitioner in temple and Puja Kumari has admitted the said fact in her statement recorded under Section 164 Cr.P.C. on 24.07.2019. Moreover, according to certificate issued by Directorate of Statistics and Evaluation, Government of Bihar the age of Puja Kumari is 04.01.2001, accordingly, her age is more than 18 years. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Sherghati, Gaya in connection with Barachatti P.S. Case No. 279 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
