The petitioner is an accused in connection with Hajipur Nagar P.S. Case No. 62 of 2015, registered under Sections 447,448, 323 and 307 of Indian Penal Code, pending in the Court of Addl. Sessions Judge-IV, Vaishali at Hajipur.

The accusation is that petitioner Awdhesh Singh used to demand Rs. Thirty Lakhs from the informant, but he refused to pay the same due to his inability. On 18.01.2015, in the evening, while the informant was seeing the television then petitioner reached there armed with sword and asked to give money on which informant shows his inability to provide the same, then petitioner blow sword at his neck. The informant tried to save his neck, but sword hit at his hand and his elbow has been cut down in the occurrence.

Patna High Court Cr.Misc. No.16453 of 2017 (3) dt.03-05-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that admittedly the petitioner is the son of the informant and he is in custody since 21.01.2015.

Learned counsel for the State vehemently opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and nature of allegation, at present, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer of the petitioner, above named, is rejected.
