The petitioner seeks regular bail in connection with Chakai P.S. Case No. 137 of 2019 registered for the offence punishable under Section 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation against the petitioner is that as per the First Information Report the Police intercepted a Tempo and recovered a total quantity of 400 liters of spirit. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case by the Police with oblique motive. Learned counsel further submits that petitioner has got no criminal antecedent and he is the driver of the Tempo from which illicit liquor has been recovered and the
Patna High Court CR. MISC. No.74791 of 2019(2) dt.11-12-2019 2/2 owner of the vehicle is one Krishna Sah. Learned counsel further submits that the co-accused namely, Md. Danish Khan, who was found sitting in the Tempo has been granted bail vide Cr. Misc. No. 82241 of 2019. Learned counsel further submits that petitioner is in custody since 23.08.2019. Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent and he is in custody since 23.08.2019, I am inclined to enlarge the petitioner on regular bail. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 2nd, Jamui in connection with Chakai P.S. Case No. 137 of 2019.
