The petitioner apprehends his arrest in connection with Ujiarpur P.S. Case No.243 of 2022, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 504 and 506 of the Indian Penal Code. The prosecution case, in brief, is that on 03.05.2022 at about 9.00 p.m., the informant was sitting on his darwaza, the petitioner alongwith other co-accused persons are said to have come there with different weapons and started abusing the informant. When the informant protested, the petitioner assaulted the informant by means of iron rod causing fracture injury to him.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.70444 of 2022(2) dt.31-01-2023 2/2 petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is case and counter case between the parties and both sides sustained injuries. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner by submitting that there is specific allegation against the petitioner that he assaulted the informant by means of iron rod causing fracture injury to him. Considering the fact that the injury sustained by the informant is grievous in nature, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected. (Anjani Kumar Sharan, J) S.KUMAR/- U T
