The petitioner seeks bail in connection with Jaynagar P.S. Case No. 19 of 2016, registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that on 17.01.2017 at about 4.30 PM, Ram Pukar Singh, younger brother of the informant, had gone to Dulipatti market for selling the vegetables, but he did not return to his house. Thereafter, informant and Suryadeo Mahto, uncle of the informant, proceeded towards Dullipatti market and when he reached near Bhisha Tole, he heard the sound of firing and saw six persons, including the petitioner, moving in fast speed boarding on the motorcycle towards Bhisha village.

No.15142 of 2017 (2) dt.27-04-2017 2/2 Learned counsel for the petitioner submits that informant is not the eye-witness of the occurrence and he only raised suspicion against the petitioner & others regarding involvement in the occurrence. Later on, in course of investigation, Raj Kumari Devi and Jeet Lal Singh, who have inimical term with the petitioner, disclosed that petitioner along with Jitendra Kumar Singh, Birendra Singh, Kishore Yadav, Shiv Narayan Yadav, Shiv Kumar Mahto and two unknown caught hold to deceased Ram Pukar Singh and co-accused Jitendra Singh fired at him, who died on the spot. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in connection with Jaynagar P.S.
