2. The petitioners seek regular bail in connection with Asthawan P.S. Case No. 145 of 2023 for the offences registered under Sections 341, 323, 420, 467, 468, 471, 120(B) of the Indian Penal Code.
3. As per the prosecution case, co-accused Ajit Kumar, son of Petitioner No. 1 got executed a registered will in his name by impersonating some other lady.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Petitioner No. 1 is an aged person. Informant and
Patna High Court CR. MISC. No.74368 of 2023(3) dt.12-02-2024 2/2 petitioners are agnates. Petitioners have no criminal antecedent. They are in custody since 24.08.2023. Charge-sheet has already been submitted. There is no chance of tampering with the evidence or absconding of the petitioners.
5. Learned counsel appearing on behalf of the State assisted with learned counsel for the informant vehemently oppose the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioners, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Asthawan P.S.
