JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 This is an application for grant of anticipatory bail in connection with Kursakanta P. S. Case No. 119 of 2019 disclosing offences under Sections 147, 148, 149, 323, 427, 379, 295, 504 and 506 of IPC.
As per F.I.R. allegation against the petitioners is of Lootpat and also of creating communal harmony between the parties and entered into the colony of the informant and
Patna High Court CR. MISC. No.66429 of 2019(3) dt.09-01-2020 2/2 threatened to set fire in the colony.
Submission of the learned counsel for the petitioners is that altogether 39 persons are named in the F.I.R. No specific allegation has been attributed against them. There is case and counter version to the occurrence also.
Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-V, Araria, in connection with Kursakanta P. S. Case No. 119 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
