2. Petitioner seeks regular bail in connection with Ahiyapur P. S. Case No. 229 of 2024 in a case registered for the offence punishable under Section 302 and 34 of the Indian Penal Code.
3. The case of the prosecution is that on 18.02.2024 at about 6:00 PM the son of the informant had gone to take vegetables and did not return till night. On 19.02.2024, the informant found the dead body of his son. It is alleged that some unknown assailant had murdered his son by cutting his neck.
4. Learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of the petitioner surfaced during course of investigation in the confessional
Patna High Court CR. MISC. No.69880 of 2025(2) dt.04-11-2025 2/2 statement of co-accused Arun Kumar and also on the suspicion raised by one of the family member of the deceased. Similarly situated other co-accused person Raju Kumar has already been granted bail by a co-ordinate Bench of this Court vide order dated 16.10.2025 passed in Cr. Misc. No. 50227 of 2025. Petitioner is in custody since 26.05.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 11th , Muzaffarpur in connection with Ahiyapur P. S. Case No. 229 of 2024.
