The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 387/452/34 of the Indian Penal Code and Section 27 of Arms Act. As per prosecution case, informant who is proprietor of a shop in the name & style of Ranjan Vastralaya alleged that the petitioner along with co-accused persons demanded as ransom of Rs. 1.5 crore and threatened that if he did not fulfill their demand he would be killed.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to pending money

Patna High Court CR. MISC. No.73542 of 2022(2) dt.21-03-2023 2/2 dispute. During investigation neither any witnesses have attributed any overt act against the petitioner nor any incriminating articles have been recovered from his conscious possession. It is further submitted that the petitioner is languishing in judicial custody since 16.09.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Town P.S. Case No. 789 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur.
