1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 308(3), 109, 118(1) and 115(2) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that named accused persons including the petitioner along with 4-5 unknown accused came and asked the informant to stop the construction of his house and demanded extortion of Rs. 5 Lakhs or in lieu thereof to register 5 katha of land in their name, further Mallu caught Rohit and petitioner assaulted him by an iron rod causing injury on head, while Jitendra assaulted Rohit by kudal on head causing injury and he became unconscious,

Patna High Court CR. MISC. No.69786 of 2025(2) dt.01-11-2025 2/3 thereafter Mohit caught Deepak and Santosh assaulted by an iron rod causing injury on head, further Mohit was caught by the police and injured were taken to the hospital.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant on account of dispute relating to land. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that petitioner along with Jitendra are alleged to have assaulted Rohit causing injury on head. It is next submitted that from perusal of the order impugned, it would manifest that Rohit suffered simple injury, it is also submitted that though it is alleged that petitioner along with Jitendra assaulted Rohit by iron rod and Kudal, but then he suffered only one injury. It is next submitted that the injury caused to Deepak has been opined to be grievous which has been inflicted by Santosh and Santosh is not the petitioner.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.69786 of 2025(2) dt.01-11-2025 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Buxar (Mufassil) P.S. Case No. 276 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. Accordingly, the instant anticipatory bail application stands allowed.
