2. Petitioner seeks regular bail in case registered for the offences punishable under Sections 108 (1) , 103 (1) and 351 (1) of BNS.
3 . The prosecution case , in brief, is that informant namely, Nasima Khatoon alleged that on 08.07.2024 , this

It is further alleged that next morning, the informant discovered her son dead, hanging under suspicious circumstances. She has further asserted a strong suspicion that the accused persons clandestinely caused his death and staged it as a hanging.
4. Learned counsel for the petitioner submitted that petitioner is innocent and has committed any offence as alleged. Informant is not an eye witness to the alleged occurrence . In fact, the deceased had committed suicide inside his residence on 08.07.2024, whereas the F.I.R. was registered on 09.07.2024, subsequent to the preparation and disposal of the inquest report. After investigation, police submitted chargesheet under Sections 108(1) and 351(1) of the BNS, which were incorporated into the F.I.R. on 04.08.2025 . There is no eye witness to the alleged occurrence . Apart from mere suspicion, no substantive material has been brought on record that could prima facie establish the involvement of this petitioner in the alleged incident. Petitioner is in custody since 04.08.2025 .
5 . Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, materials available
Patna High Court CR. MISC. No.69593 of 2025(3) dt.25-11-2025 3/3 on record, period of custody and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM Sadar Sitamarhi in connection with Bela P. S. Case No. 167 of 2024 .
