2. The petitioner has preferred this application for grant of regular bail in connection with Paharpur P.S. Case No. 385 of 2024 dated 16.08.2024 registered for the offences punishable u/ss 126(2), 115(2), 80 read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have killed the informant's daughter due to non-fulfillment of demand of Swift Dezire Car as dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is the father-in-law of the deceased and

Patna High Court CR. MISC. No.71789 of 2025(2) dt.01-11-2025 2/2 he was living separately from the deceased. The petitioner neither demanded any dowry nor tortured the deceased. The petitioner has no concern with the alleged offence. The coaccused persons have already been granted anticipatory bail by this court vide order dated 02.07.2025 passed in Cr. Misc. No. 6701/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Motihari in connection with Paharpur P.S. Case No. 385 of 2024.

7. The application stands allowed.
