04-04-2018 Perused the show cause filed by the deponent Guddu Kumar Sah. He has stated that a mistake has been committed while instructing the learned counsel for the petitioner and thereby as regards the criminal antecedent of the petitioner it has been wrongly stated that the petitioner has got no criminal antecedent. He has tendered unqualified apology with undertaking that in future without his personal knowledge he will not swear any affidavit.
Although learned counsel representing the informant has pointed out that this deponent happens to be a family member and has himself got some criminal antecedent, at this stage, since learned counsel for the petitioner seeks permission to withdraw this application itself, I am not going into those issues. Petitioner is warned
Patna High Court Cr.Misc. No.7289 of 2018 (4) dt.04-04-2018 that in future if he is found swearing false affidavit, appropriate order for prosecution shall be passed not only in the case in which he will swear fresh affidavit but also in this case.
The anticipatory bail application is dismissed as withdrawn.
