2. The petitioner seeks regular bail in the present case registered for the offence under Sections 363, 366A of the Indian Penal Code and Section 12 of the POCSO Act.

3. As per the prosecution case, petitioner is alleged to have kidnapped the daughter of the informant with intention to marry her.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 18.08.2024. He further submits that the victim in her statement recorded U/s 161 of the Cr.P.C.

Patna High Court CR. MISC. No.75262 of 2024(3) dt.22-01-2025 2/2 has stated that she had eloped and got married to the petitioner.

5. Learned counsel for the informant has supported the bail application of the petitioner.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-VI-cum-Special Jude, POCSO Act, Banka/concerned Court below in connection with Dhoraiya P.S. Case No. 147 of 2023.

8. This application stands allowed.
