JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-04-2017 The petitioner is in custody since 18.01.2017 in connection with Jhajha P.S. Case No. 122 of 2016, registered for offences punishable under Sections 399 and 402 of Indian Penal Code as well as Section 25(1-B)a, 26 and 35 of Arms Act. Allegation is that police on information that some persons were planning for robbery and kidnapping, raided the place and caught seven accused persons and petitioner along with others managed to escape from there and the persons, who were apprehended on spot disclosed the name of the petitioner. It has been submitted on behalf of the petitioner that from perusal of F.I.R., itself it will appear that petitioner has not been apprehended on the spot rather his name was disclosed by one of the accused persons, who were apprehended on the spot. No.18124 of 2017 (2) dt.21-04-2017 2/3 no recovery has been made from the possession of the petitioner and he has been made accused in this case only on the basis of suspicion, for which petitioner has been in judicial custody since 18.01.2017 and other co-accused have already been granted bail vide orders dated 13.01.2017, 28.10.2016, 27.10.2016, 09.12.2016 and 04.10.2016 passed in Criminal Miscellaneous Nos. 1175 of 2017, 47202 of 2016, 47132 of 2016, 49606 of 2016 and 44009 of 2016, respectively.

Having heard both sides, considering the aforementioned facts and circumstances of the case, nature of allegation, period of custody and also other co-accused have already been granted bail by this Court, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Jamui in connection with Jhajha P.S. Case No. 122 of 2016, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
