JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This is an application for grant of anticipatory bail in connection with Barh P. S. Case No. 471 of 2018 disclosing offences under Sections 363 and 366A of IPC.

As per F.I.R. there is allegation against the petitioner and other accused persons of kidnapping the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that in the statement under Section 164 Cr.P.C. she has not stated about the petitioner, who has kidnapped her, rather she has stated that she was taken to the house of the petitioner and he has not done any other act with her. Further matter has been compromised between the parties. A compromise petition has been filed by the informant before the court of ACJM. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Barh, in connection with Barh P. S. Case No. 471 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
