The petitioner apprehends his arrest in connection with Nauhatta P.S. Case No.122 of 2022, registered for the offence punishable under Section 7 of the Essential Commodities Act.

The prosecution case, in brief, is that on 10.10.2022 at about 10.00 a.m., the informant was informed by the Officer-inCharge, Nauhatta that one pick-up van loaded with 50 bags of wheat and rice was seized and is kept in the police station. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph 3 of the bail petition. The apprehended person disclosed that wheat and rice belongs

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected.

However, if petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the learned court below shall consider the prayer for regular bail of the petitioner preferably on the same day without being prejudiced by this order considering the fact that some of the accused persons have been granted bail by the learned court below itself.
