JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 341, 323, 504, 506, 366A, 120B and 34 of the Indian Penal Code.
Allegation against petitioner is that he has kidnapped the daughter of the informant. It is further alleged that when father and uncle of the victim girl went to the house of the petitioner to get back their daughter, accused persons including the petitioner assaulted informant and his brother with fists and slaps and got their signature on a plain paper. Thereafter, the victim was recovered.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that both parties are next door neighbour and petitioner has been made
Patna High Court Cr.Misc. No.16782 of 2017 (2) dt.17-04-2017 2/2 accused due to petty dispute. The F.I.R. has been lodged after much delay.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner. Having heard both sides, in view of the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.
However, petitioner is directed to surrender in the court below, i.e., learned S.D.J.M., Arwal, in connection with Mehandiya P. S. Case no. 126 of 2015 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
This application stands disposed of.
