The petitioner apprehends his arrest in Jamui P.S. Case No.301 of 2016 registered under Sections 376, 511, 341, 323, 324, 504/34 of the Indian Penal Code.
The informant alleged that the petitieoner entered into her house in the dead of night and made attempt to outrage her modesty. The informant raised alarm. Thereafter, the petitioner fled away.
The learned counsel for the petitioner submits that petitioner happens to be brother-in-law(devar) of the informant. There is a land dispute between the husband of the informant and the petitioner that is why this false case has been lodged but it appears that the petitioner has not annexed any chit of paper to
Patna High Court Cr.Misc. No.11426 of 2018 (3) dt.08-03-2018 show that in fact, petitioner has got any land dispute with the husband of the informant. The informant made specific allegation that while she was sleeping in her house, in the dead of night, it was the petitioner who entered into the house and made attempt to outrage her modesty. During the course of investigation the witnesses also reiterated the same facts.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
