JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2018 Heard learned counsels for the petitioner and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379 of the IPC. The prosecution case, as per the written report of Narendra Thakur dated 28.08.2017 at 2.15 PM submitted to the Station House Officer, Patrakar Nagar Police Station is to the effect that on 28.08.2017 at 12.30 PM, one lady customer came to the shop of the informant and purchased one 43" Samsung L.E.D. T.V. and she conveyed to the informant that she will send the money through the carrier of the T.V. as she has not brought the money, then the T.V. was sent on a rickshaw carrier. When the carrier reached to the house of the said lady, she said to the rickshaw puller that she forgot the key on the T.V. shop and asked the

No.6418 of 2018(2) dt.02-02-2018 2/3 rickshaw puller to bring the key when the rickshaw puller went to bring the key, in the meantime, the alleged lady disappeared with the T.V., leading to registration of the present case. During investigation, name of alleged lady was surfaced as Seema Singh, but T.V. was recovered from the house of this petitioner. It is submitted by learned counsel for the petitioner that the T.V. has been recovered from the in-laws house of the petitioner and she is in serious litigated relationship with her in-laws family. Usa Singh, who is the mother-in-law of the petitioner has filed a petition before the learned Court below to the effect that the premises in question belongs to her, though, the area from where the T.V. has been recovered, is in occupation of the petitioner. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the thrust of accusation is against the petitioner.

Considering the nature of accusation, the petitioner being the lady and the petitioner not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like
