The petitioners apprehend their arrest in Mushahari P.S. Case No.130/2017, registered under Sections 341, 323, 325, 307, 427 and 504 of the Indian Penal Code.
The informant Maujelal Sahani named the petitioners and others and alleged that Yugeshwar Sahani was cutting mango tree then the informant forbade. Thereafter Ranjit Sahani, Chandul Sahani, Mandul Sahani, Lalmuni Devi, Muni Devi, Dharmshila Devi and others came there one by one. Chandul Sahani assaulted the informant with iron rod on his back, causing fracture injury. When Rajdev Sahani came to save the informant, Ranjit Sahani assaulted Rajdev Sahani, causing injury on his head. Petitioners
Patna High Court Cr.Misc. No.11518 of 2018 (2) dt.27-02-2018 2/2 Dharmshila Devi, Muni Devi and Manjul Sahani are alleged to have assaulted Nibha Devi and Manju Devi.
Learned counsel for the petitioners submits that Nibha Devi got one abrasion on left arm and Manju Devi did not receive any apparent injury.
Considering the aforesaid facts, the petitioners above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge-VI-cum-A.C.J.M., Muzaffarpur, in connection with Mushahari P.S. Case No.130/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
