The petitioners in this case are seeking anticipatory bail in connection with Bajpatti P.S. Case No.168 of 2019 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Learned counsel submits that there is no specific allegation of assault against these petitioners.

Learned APP for the State is present and has opposed the prayer for anticipatory bail of the petitioners. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.69098 of 2019(2) dt.11-12-2019 2/2 wherein both the petitioners are named in the FIR and the allegations against them are that they had assaulted the father of the informant which caused bleeding, this Court is not inclined to grant privilege of anticipatory bail to the petitioners. The contention of learned counsel for the petitioners that there is a dispute over a piece of land and both the parties have lodged case and counter case against each other shall be considered by the court below, if the petitioners surrender and pray for regular bail within a period of four weeks from today.
