The petitioner seeks bail in a case registered under Sections 498(A), 307, 324/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Allegation against the accused persons including the petitioner is of committing torture upon the victim due to nonfulfilment of demand of dowry. The petitioner also tried to cut neck of the victim, but she was saved by the villagers. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.07.2018 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.67281 of 2019(2) dt.22-10-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to petty reason. The nature of injury is said to be superficial. Except for offence under Section 307 of I.P.C., other offences are triable by the Magistrate. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 1st, Kishanganj in connection with Kishanganj P.S. case No.472 of 2018 giving rise to Sessions Trial No.215 of 2018.
