The petitioner seeks bail in a case registered under Section 379/411 of the Indian Penal Code.

Allegedly, the motorcycle of the informant was found in the courtyard of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 28-08-2019. The stolen motorcycle is said to have been recovered from house of the petitioner. The petitioner had no knowledge that the motorcycle in question is a stolen property. The petitioner has been made accused in the present case due to mistake of fact.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Madhubani in connection with Basopatti P.S. Case No. 208 of 2019.
