JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Giriyak P.S. Case No. 228/17 registered for the offences punishable under Sections 341, 323, 504, 302/34 of the Indian Penal Code.
The allegation against the petitioner is that she along with co-accused Dilip Chaudhary and Nawlesh Chaudhary assaulted the deceased by means of iron rod but police after due investigation submitted final form in respect of the petitioner showing the accusation untrue. However, it is informed that the learned court below having differed with the findings of the police took cognizance against the petitioner also. Since, the petitioner happens to be the lady and in course of investigation, her involvement was not found in the
Patna High Court CR. MISC. No.66695 of 2019(4) dt.05-03-2020 2/2 present case, it is ordered that petitioner, in the event of her arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XI, Nalanda in Giriyak P.S. Case No. 228/17 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
