The petitioner seeks regular bail in connection with N.D.P.S.Case No.5 of 2016 arising out of Amnour P.S.Case No.197 of 2016 registered for offences punishable under Sections 20 of the N.D.P.S. Act.

Allegation against the petitioner is about recovery of 3.500 kg. of 'Ganja' from the house of the petitioner. It is submitted on behalf of the petitioner that he has been falsely implicated in this case. He has no criminal antecedent and the seized 'Ganja' is less than the commercial use. He has remained in custody for more than six months. Heard learned A.P.P. also, who has opposed the prayer for bail.

No.19577 of 2017 (2) dt.04-05-2017 2/2 Having heard both sides and in view of allegation of recovery of 3.500 kg. of 'Ganja', which is more than the small quantity, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. With the aforesaid observation, this application is dismissed.
