2. In the present case, the petitioner seeks bail in connection with Suryapura P.S. Case No. 164 of 2024, registered for the offences under Sections 467, 468, 420, 419 of the Indian Penal Code.

3. As per the prosecution case, police received information about petitioner making forged arms licenses, a raid was conducted in the house of the petitioner and a person fled away from the house who was identified as the petitioner by the mahal chowkidar. On search of the house of the petitioner one forged arms license for single barrel gun was recovered.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has been

Patna High Court CR. MISC. No.70358 of 2025(2) dt.09-10-2025 2/3 falsely implicated in this case. Nothing incriminating has been recovered from the conscious possession of the petitioner. From the FIR itself, it is clear that the petitioner used to work in Chennai as a guard. When the recovery was made from the house of the petitioner, no copy of the seizure list was served to the members of the family. Moreover, petitioner was not present in the house, no illegal arms has been recovered from the house of the petitioner. There is no complaint regarding any forgery being done by the petitioner. The petitioner has no criminal antecedent and is in custody since 09.05.2025. The charge-sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that petitioner was not apprehended from the spot and nothing incriminating has been recovered from his conscious possession and also considering his clean antecedent, period of custody, submission of charge-sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -Ist

Case No. 164 of 2024, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
