JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 06-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Shivsagar P.S. Case No. 328 of 2017 for the offences punishable under sections 147, 148, 149, 323, 447, 307, 504 and 506 of the I.P.C and section 27 of the Arms Act.
Allegedly, in the occurrence the petitioner assaulted Sanjay Kumar Singh with Rami on his head.
Submission is of false implication and that the injured Sanjay Kumar Singh has received one lacerated wound 3"x 1⁄4"x muscle deep in scalp, he was advised for x-ray but x-ray report has

No.17135 of 2018 (2) dt.06-04-2018 2/2 not been received up till now, such injury may be treated as simple, due to the land dispute the occurrence has taken place, there is case and counter case, Sheosagar P.S. Case No. 329 of 2017 has been lodged against the informant and others, no offence under section 307 of the I.P.C. and section 27 of the Arms Act is made out against the petitioner as there is no allegation of repeating the blow.
The learned A.P.P. submits that on the head injury has been caused.
In the facts and circumstances stated above, considering that there is no allegation of repeating the blow and the petitioner has got no criminal antecedent and as such the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub. Judge-VII- Cum- A.C.J.M, Rohtas at Sasaram in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
