The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 323, 325 and 307 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent, it is next submitted that petitioner is not alleged to have assaulted the informant and his brother while he was making roof to tie the animals. It is further submitted that in order to give serious colour to the case against the petitioner, it is alleged that he threatened with pistol, but then there is no allegation of firing nor F.I.R. is registered under the Arms Act.
Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.7721 of 2023(4) dt.10-07-2023 2/2 anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Aanti P.S. Case No. 40 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
