The petitioner seeks bail in a case registered under Sections 341, 323, 354 of the Indian Penal Code and 6/8 of POCSO Act.

Allegation is that when the informant's daughter, namely, Bandana Kumari had gone to attend natural call, in the way the petitioner caught her with bad intention. It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.9.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Due to irrigation of field, some dispute had

Patna High Court CR. MISC. No.68177 of 2019(2) dt.19-11-2019 2/2 taken place and for the said purpose a false case has been instituted by the petitioner. The allegation of misbehaving with the victim is denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1-cum-Special Judge, Kaimur at Bhabhua in connection with POCSO Reg. No.42 of 2019 arising out of Durgawati P.S. case No.246 of 2019.
