JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 9-11-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case instituted for the offence under Sections 304(B) of the Indian Penal Code and Section 4/8 of Dowry Prohibition Act.

As per allegation in the FIR, petitioner along with his family members has tortured in various ways to the daughter of the informant due to non-fulfillment of additional dowry demand and ultimately she was being killed by throttling. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is father-in-law of the deceased and has been falsely implicated in this case. He has no concern mess and business of the deceased or his husband and lives separately from them. The sole responsibility to take care of wife is upon

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Gaya in connection with Guraru P.S. Case No. 130 of 2022.
