The petitioner apprehends his arrest in Kasim Bazar P.S. Case No.184 of 2019 registered under Sections 25(1-b)a, 25(1-AA), 26 and 35 of the Arms Act.

The police on the basis of the secret information that Deepak Mandal and his wife were supplying illegal arms and ammunition, on such a raid was conducted. Arms and ammunition with carbine were recovered from the house of Deepak Mandal and his wife. Deepak Mandal disclosed that petitioner is indulged in manufacturing the arms and he had given the arms to him for supply.

The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. Save and except the disclosure made by Deepak

No.67238 of 2019(2) dt.04-11-2019 2/2 Mandal, there is no material to show that the petitioner is indulged in manufacturing illegal arms but it appears that petitioner has got criminal antecedent and he is accused in as many as seven criminal cases registered under different Sections of Indian Penal Code and Arms Act including Sections 302, 307, 387 of the Indian Penal Code.

Taking into consideration the fact that the petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Saurabh/- U T
