2. The petitioner is in custody in a case registered for the offences punishable under Section 30(a), 30(c) of the Bihar Prohibition and Excise Act.
3. As per the allegation in the FIR, total 45 litres of mahu distilled(made) country liquor and 200 kg of mahua flowers kept in different plastic galleons has been recovered from the house of the petitioner.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that petitioner has no concern with the alleged recovery and alleged recovered articles have been recovered from the
Patna High Court CR. MISC. No.70396 of 2025(2) dt.08-10-2025 2/2 joints family property of the petitioner. He further submits that witness of the seizure list were police officials. He next submits that petitioner is in judicial custody since 21.07.2025 and has got one criminal antecedent as stated in para-3 of the bail petition.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. Considering the above facts and circumstances of the case, submission of learned counsel for the petitioner, let the above named petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise-II, Aurangabad in connection with Dhibra P.S. Case No. 61 of 2025.
