This application is for grant of regular bail in connection with Muzaffaprur Town P.S.Case No.122 of 2007 (Tr. No.105 of 2016) for the offences under Sections 20, 22, 27/27A of the N.D.P.S. Act.

This case is misuse of privilege of bail. It further appears that in the year, 2013, the case was fixed for argument but the petitioner absconded, as such the trial could not be concluded. The petitioner has surrendered on 17.03.2016.

It is submitted on behalf of the petitioner that he has remained in custody for more than nine months. Heard learned A.P.P. also.

Having heard both sides and in view of the fact that the case

Patna High Court Cr.Misc. No.20692 of 2017 (2) dt.08-05-2017 2/2 was fixed for argument but due to non-appearance of the petitioner, the trial could not be concluded, as such, I am not inclined to grant bail to the petitioner, however, considering the fact that he has remained in custody for about nine months, the learned trial court is directed to expedite the trial as soon as possible.

With the aforesaid observation, this application is dismissed.
