The petitioner, who is in custody since 17.07.2019 and has clean antecedent, seeks bail in connection with Special Case No. 342 of 2019, instituted under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

21.25 litres of liquor is said to have been recovered from the trolley bag of the petitioner which has been kept by him in the boot of the bus in which he was travelling.

No.74225 of 2019(2) dt.11-12-2019 2/2 It has been submitted on behalf of the petitioner that he has been made accused in this case with the aforesaid accusation because of his having picked up a fight with the local police. The trolley bag does belong to the petitioner but the contents thereof is being denied.

Considering the period of custody and taking into account the fair antecedent of the petitioner, this petition is allowed.

The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 2nd cum Special Judge, Excise, Kishanganj in connection with Special Case No. 342 of 2019.
