The petitioner seeks bail in Case No. C2/123/2017, registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

The house of the petitioner was searched and from the roof of the house 600 bottles of Nepali liquor kept in 20 cartoons were recovered, each bottle contains 180 ml. 108 litres of Nepali liquor was recovered from the house of the petitioner and for that the petitioner is in jail since 28.02.2017. The petitioner has remained in jail for more than 02 months and he has got no criminal antecedent.

Considering the facts aforesaid, the petitioner above-

Patna High Court Cr.Misc. No.20695 of 2017 (3) dt.05-05-2017 named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Case No. C2/123/2017.
