The petitioner apprehends his arrest in Bagaha (Bhairoganj) P.S. Case No. 312 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.
The informant named the petitioner along with other accused persons and made omnibus and general allegation that they all assaulted the informant and his family members. Learned counsel for the petitioner submits that no specific allegation of assault is made against the petitioner. It transpired that during course of investigation Om Prakash and Ram Bali Ram @ Rambilash Ram, the petitioner assaulted
Patna High Court Cr.Misc. No.18166 of 2017 (2) dt.16-05-2017 2/2 Birendra Ram. Banshi Ram assaulted the aunt of the informant. The injury found on the head of Birendra Ram is opined to be grievous in nature.
Considering the facts aforesaid and the fact that on account of assault made by the petitioner, Birendra Ram got grievous injury on his head, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
The petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order.
