In this application for anticipatory bail the petitioner apprehends his arrest in connection with Shambhuganj P.S. Case No. 195 of 2017 for the offences punishable under sections 341, 323, 354 (B), 379, 504 and 506/34 of the I.P.C. In the FIR allegation against the petitioner is that he tried to outrage modesty of the informant who is none else but the Bhabhu of the petitioner and torn her Buloj also. Submission is of false implication and that due to land dispute this case has been lodged, no offence under section 354 (B) of the I.P.C. is made out against the petitioner that is super addition, Shambhuganj P.S. Case No. 42 of 2016 and Complaint
Patna High Court Cr.Misc. No.17283 of 2018 (2) dt.10-04-2018 2/2 Case No. 887 of 2008 are also going on between the parties and one case in Gram Panchayat is going on and as such the petitioner deserves sympathetic consideration.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.
In the facts and circumstances stated above, considering the allegation attributed against the petitioner, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of S.D.J.M.
