The petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code and Sections 3⁄4 of Explosive Substance Act. Charge sheet has been submitted under Sections 395, 397, 412 of I.P.C.

Allegation is that some unknown miscreants assaulted informant's brother with brick and they took away the mobile and motorcycle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.05.2019 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R.

Patna High Court CR. MISC. No.68555 of 2019(2) dt.25-10-2019 2/2 His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the petitioner. It is further submitted that the petitioner may be released on bail after completion of nine months in custody from 15.05.2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. The petitioner is said to have been identified in the T.I.P.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of nine months in custody from 15.05.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Biraul, District Darbhanga in connection with Ghanshyampur P.S. case No.92 of 2019.
