The present interlocutory application has been filed on behalf of the petitioner to amend the prayer in the main writ application i.e. to quash the memo no.327 dated 31.03.2020 issued by the District Education Officer, East Champaran, Motihari, whereby and where-under the petitioner has been terminated from the service on the grounds that the training certificate of the petitioner declared invalid.

3. Having heard learned counsel for the parties, I.A. No.1 of 2023 is allowed and prayer made in this application shall

4. Learned counsel for the petitioner submits that the case of the petitioner is squarely covered with the judgment dated 28.08.2023 passed in L.P.A. No.1254 of 2016 and other analogous cases, hence the petitioner is entitled for grant of similar benefits.

In view of the aforesaid, memo no.327 dated 31.03.2020, issued by the District Education Officer, East Champaran, Motihari is hereby quashed and the petitioner is directed to file a detailed representation before the District Education Officer, East Champaran, Motihari (respondent no.4) along with a copy of the judgment dated 28.08.2023 passed in L.P.A. No.1254 of 2016 and other analogous cases as also with all supporting documents within a period of four weeks. After receipt of such representation, the respondent no.4 shall pass a reasoned and speaking order within four weeks thereafter.

6. It is made clear that respondent no.4 shall be held responsible for non-compliance of this order within the stipulated period.
