2. The petitioner has prayed for bail in connection with Pachpakri P.S. Case No.10 of 2024 registered for the offence punishable under Section 96 of B.N.S.

3. The case of the prosecution is that the sister of the informant, namely, Nazia Praveen aged about 15 years has gone to fetch vegetable and when she did not return for a considerable time, the informant started searching and he came to know that the petitioner along with Sandeep Kumar, Mithilesh and Vikram Kumar has kidnapped his sister for the purpose of marriage.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.76256 of 2024(3) dt.22-01-2025 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It is further submitted that during course of investigation, the victim has given her statement under Section 164 of the Cr.P.C. wherein she has stated that on the date of occurrence she has called Ranjan Paswan (petitioner). She along with Ranjan Paswan and Sandeep Kumar went to Akauna. Sandeep was driving bike and she was sitting with the petitioner. She went to the house of aunt of petitioner where she solemnized marriage with the petitioner. In medical report, the age of the victim has been 18-20 years which is clear from the order of the trial Court itself. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Petitioner is languishing in judicial custody since 03.08.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
