2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the BNS.

3. As per the prosecution case, all the accused persons including this petitioner killed brother of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. There is no eye witness to the alleged occurrence. Petitioner claims clean antecedent and is in custody since 28.12.2024.

Patna High Court CR. MISC. No.70839 of 2025(3) dt.25-11-2025 2/2 A.P.P. for the State vehemently opposes the bail application and submits that petitioner is named in the FIR. At the behest of this petitioner, the weapon which was used in the commission of the crime has been recovered. Hence, he does not deserve regular bail.

6. Considering the nature of accusation, prayer for bail of the petitioner is rejected. However, since petitioner is in custody since 28.12.2024, Trial Court is directed to expedite and conclude the trial, preferably, within a period of one year from the date of receipt/production of copy of this order.
