====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-02-2024 Heard learned counsel for the petitioners and Mr. Navin Kumar Pandey, learned A.P.P. for the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 354(B)/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner No. 1 is alleged to have assaulted on the head of the informant with lathi and petitioner No. 2 is alleged to have snatched golden ring from the informant.

4. It is submitted that the injury allegedly caused by the petitioner No. 1 is found to be simple in nature and allegation of snatching the golden ring is ornamental. Moreover,

Patna High Court CR. MISC. No.72550 of 2023(3) dt.29-02-2024 2/2 F.I.R. has been filed after delay of two days without any plausible explanation. Petitioners claim clean antecedent.

5. Considering the simple nature of injury and delay in lodging the F.I.R., this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Muffasil P. S. Case No. 385 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
