Mr. SRI NAND KUMAR ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Kahalgaon (Rasalpur) P. S. Case No. 201 of 2017 registered for the offences punishable under Sections 366A, 504/34 of the Indian Penal Code.

Allegedly, the daughter, aged about 16 years, of the informant was kidnapped by the petitioner and other co-accused and when inquiry was made they caused threats. During investigation the victim was recovered and her statement under Section 164 Cr.P.C. was recorded wherein she has stated that on 06.05.2017 she went with co-accused Saurav Kumar to Nawabganj where she met with the petitioner. She has stated

Patna High Court Cr.Misc. No.11313 of 2018(2) dt.27-02-2018 2/2 that she went to Nawabganj out of her own sweet will. Submission is of false implication and that in view of the statement of the victim no offence as alleged is made out against the petitioner and as such the petitioner deserves sympathetic consideration.

Learned APP fairly submits that the victim has denied regarding her kidnapping.

In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kahalgaon (Rasalpur) P. S. Case No. 201 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
