The petitioner apprehends his arrest in Triveniganj P.S. Case No. 211 of 2016 registered for the offences punishable under Sections 307 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.
The informant named four persons namely Bedanand Yadav, Vijendra Yadav, Birendra Yadav and Surendra Yadav. On the order of Bedanand Yadav, Vijendra Yadav the petitioner fired which hit in the abdomen of his brother.
Learned counsel for the petitioner submits that the informant named the petitioner as the person who fired at the brother of the informant but the injured, himself, disclosed that the petitioner caught him and Bedanand Yadav fired which hit in his abdomen.
Patna High Court Cr.Misc. No.19666 of 2017 (2) dt.06-07-2017 2/2 It appears from perusal of the order of this Court passed in Cr. Misc. No. 3595 of 2017 that it was Vijendra Yadav who fired.
Considering the facts aforesaid and the fact that it was the petitioner who fired, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
