The petitioners seek bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 307, 353, 337, 338, 224 & 225 of the Indian Penal Code and 27 of the Arms Act. The prosecution case in short is that while the police went to village Tungi to arrest an accused of Deepnagar P.S. Case No. 167 of 2019, the local residents of the said accusesd attacked upon the police party by means of bricks,stones and Lathi etc. as a result of which, the police personnel sustained injuries. It has been submitted on behalf of the petitioners that there is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.64122 of 2019(2) dt.17-10-2019 2/2 petitioners. The petitioners are in custody since 22-08-2019. The alleged occurrence is said to have taken place at 8.15 p.m. No source of identification is disclosed by the prosecution. General and omnibus allegation has been made against the petitioner. No overt act is alleged against the petitioner. The nature of injury is said to be simple.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Deepnagar P.S. Case No. 236 of 2019.
