JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Muffasil (Singhoul O.P.) P.S. Case No. 212 of 2019 registered for the offences punishable under Sections 363, 366 and 34 of the Indian Penal Code.

As per FIR petitioner and other accused persons had kidnapped married daughter of the informant.

Submission of learned counsel for the petitioner is that later on name of the petitioner has been inserted in this case and victim has filed a petition before the court of Chief Judicial Magistrate stating that due to ill behaviour of the husband and informant she fled away and accused persons are innocent. Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that the girl has not appeared till

Patna High Court CR. MISC. No.71471 of 2019(2) dt.08-11-2019 2/2 date and her statement has also not been recorded, rather a petition has been filed by her, as submitted by learned counsel for the petitioner.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, it is always open to the petitioner to appear along with the victim girl in the court and pray for regular bail, which shall be considered after verification of the above submission from the victim girl and, if possible, to be disposed of on the same day.

With the above observation, this application is disposed of.
