Learned counsel for the petitioner assails the impugned order of interim maintenance passed by the learned Family Court, Samastipur, by which, a sum of Rs.2,000/- has been awarded as interim maintenance to be paid by the petitioner to her parents.
Learned counsel for the petitioner submits that the respondents/parents have six daughters, but the maintenance has been claimed against the petitioner only whereas all other five daughters are competent and solvent to pay the maintenance. Learned counsel further submits that claim of maintenance from petitioner only defeats the principle of justice and equity. Having heard learned counsel for the parties and
Patna High Court C.Misc. No.830 of 2022(2) dt.15-12-2022 2/2 taking into consideration the fact that admittedly the petitioner is daughter of the respondents and it is responsibility of the petitioner to maintain her parents as per the statutory provisions. The learned Family Court, Samastipur, has awarded the interim maintenance and final order in maintenance case is still to be passed in due course.
In view of the aforesaid, I do not find any reason to interfere with the order of interim maintenance passed by the Family Court.
